Amazon defeats eBay in legal fight over alleged seller poaching
Amazon on Tuesday secured a major victory in its legal fight against eBay over alleged filching of eBay vendors.
eBay had filed two lawsuits against Amazon in Santa Clara County in 2018 and against a group of Amazon managers in the US District of California 2019.
The lawsuit accused the Seattle-based tech company of poaching e-commerce sellers through eBay’s own messaging platform. It accused Amazon’s sale representatives of secretly creating and using several eBay accounts to access the company’s internal messaging system to woo hundreds of eBay vendors to sell on Amazon in a bid to “inflict harm on eBay”.
Both suits were moved to arbitration and were reviewed together. The panel found that while there was prove of a breach by Amazon, eBay did not prove it had suffered damages as a result. eBay was unsuccessful in arguing that Amazon had coordinated poaching campaign of any sort.
The panel denied all of eBay’s claims against Amazon, according to the filings. The ruling still needs to be confirmed by the courts.
